In order to remove the condition, the petitioner must demonstrate by a preponderance of the evidence that the investment has been sustained for the entire period of conditional permanent residence and that the required number of jobs have been created.
The most important criteria is the number of jobs. One needs to be able to prove that the necessary 10+ jobs were created or deemed to have been created. Naturally, the applicant needs to stay invested during the conditional green card period as well.
You have to prove that you invested at least $500k and created at least ten new jobs. Those are the most important requirements.
