Despite the seemingly never-ending discussions of reform to the EB-5 Program, the rules for TEAs remain unchanged, as of this release date. Specifically, TEAs are still being certified by state-designated authorities, and the definitions of TEAs continue to include (1) rural areas and (2) high unemployment areas, which can be determined as a single census tract or a combination of adjacent census tracts (and block groups in some states).
Every year, states update the data they use to certify TEAs. This year, unless there are changes to the program, TEAs will be determined by 2017 unemployment data. The threshold is now 6.6%, a decrease from last year’s 7.4%. See our article for details about this year’s map and other key points.
