The Department of Homeland Security provided an update on the EB-5 Integrity Fund. The funds are to be used to administer the EB-5 Regional Center Program, per the EB-5 Reform and Integrity act of 2022. The annual fees collected from each specified regional center are being collected as of March 2, 2023.
Each regional center with over 20 investors is required to pay $20,000. Centers with fewer than 20 investors are to pay $10,000. These are both annual payments based on the FY period and are due no later than April 1, 2023. Further, a filing fee increase of $1,000 for Form I-526E, Immigrant Petition by Regional Center Investor was instituted on October 1, 2022. Centers will be terminated if they have not paid in full within 90 days of the due date of their payments.
Funds are available to support the detection and investigation of fraud and other immigration crimes.
The EB-5 Regional Center Program provides qualified immigrants and their families the option to pool investment funds to fulfill economic growth opportunities in the U.S. Investors qualify for visas upon approved investment.
