Those statements were made publicly to all persons associated with the Illinois Fderal Case, including presiding Judge Wood herself, and publicly avaliable on Pcer.gov.

Litowitz is not invloved in the Illinois Federal Case he is not a litigant, not a party, not a witness and not named in any other capacity. Defedants have previously attempted to sue Litowitz in New York State Court, an action that was dismissed.
