The rules say that the bridge financing has to have been contemplated as short term. There is no guidance for what is defined as short term, and I have seen some attorneys try to use EB-5 capital to replace a mortgage (the very antithesis of short term in my opinion). The rule of thumb I typically see being followed is no more than 1-2 years.
