The I-526 form seeks:

  • Biographical information including nationality, address history, and employment history
  • Information about your current immigration status
  • Details about your qualifying Investment
  • Information about any prior immigration proceedings which you may have been involved in, and,
  • Biographical information about your family members

While a lot of this information on the I-526 form is straightforward, much of it is complex. Hiring an immigration attorney is important. The EB-5 immigration visa practice is very specialized, and it is recommended that you find, not only an immigration attorney but an immigration attorney who is well-versed in handling EB-5 applications. This will not only help to ensure a streamlined process for preparing and submitting your application, it may also avoid unnecessary mistakes, delays, and denials.

When you have committed to becoming an EB-5 investor and retained a lawyer, you will have a lot of work ahead of you.  You will need to provide your lawyer with extensive biographical documents for you, your spouse, and any children who are seeking a visa as part of your application. Additionally, your lawyer will need to gather documents to evidence the “lawful source” of your EB-5 investment funds.
