The historical national average processing time for the I-526 petition on the USCIS page has been updated to include up to February 29, 2020.

The new historical national processing time for the I-526 petition is 12.9 months for fiscal year 2020.

The I-526 Petition is the Immigrant Petition by Alien Entrepreneur and is for foreign nationals who wish to immigrate to the United States through the EB-5 Program.

The EB-5 Program gives qualified foreign nationals green cards in exchange for making a $900,000 investment in a U.S. new commercial enterprise located in a high unemployment or rural area. For investments in non-high unemployment or rural areas the minimum investment amount is $1.8 million.

While USCIS is temporarily closed to the public for in-person services, they continue to perform duties that do not involve interacting with the public such as adjudications of EB-5 petitions. Learn more about what the USCIS temporary closures mean for EB-5 here.

The historical national average processing page tells a different story than the USCIS case processing page. Processing times at the Immigrant Investor Program Office remain the same for the I-526 Petition: 31 months – 50.5 months. As the historical national average processing page is also updated regularly, its data should be also be an EB-5 investor consideration.
