USCIS Sounds Off on EB-5 Source of Funds

On February 26, 2015, USCIS hosted an “EB-5 Interactive Series” teleconference on Requests for Evidence ("RFE") on lawful source of funds for investment.  The discussion focused on lawful sources of funds used for capital investment in the EB-5 investor program. Specifically, USCIS addressed common reasons for the issuance of RFEs and the types of evidence they expect to see in support of an I-526 petition.  USCIS offered four general tips for avoiding a source of funds RFE: (1) explain any inconsistencies in the submitted documents; (2) explain the unavailability of required documents; (3) consider the probative value of the evidence (i.e. evidence from an objective third party versus that obtained from the petitioner or his/her friends, family, or company); and (4) provide full translations of foreign language documents.
