DOS Comments on EB-5 Visa Retrogression

Every month, AILA’s DOS Liaison Committee meets with Charles Oppenheim, Chief of the Visa Control and Reporting Division of the DOS, to obtain his analysis of current trends and future projections for the immigrant preference categories. At their latest meeting on February 10, 2015, Mr. Oppenheim commented that USCIS EB-5 adjudications continue at a steady pace. He continues to predict that a cut-off date will be established for EB-5 China no later than July 2015. Please note Mr. Oppenheim reminds AILA members that cut-off dates do not move in a linear fashion, are susceptible to a number of factors, and should not be expected to behave in a predictable manner. Nevertheless, Chinese nationals should prepare for the possible cut-off date in a few months. Particularly, Chinese nationals with children who are close to reaching the age of 21 should consult with our firm regarding how the visa retrogression and Child Status Protection Act will affect his/her petition.
