Effective October 2, 2020, USCIS will adjust most of their immigration request fees. Here’s how that affects EB-5 Program filing fees.

In a news statement released by USCIS, this adjustment comes after a biennial fee review that determined that there was a need to increase fees to recover costs for services and operations. USCIS is 97% funded by these immigration fees and they state that without this adjustment that they would be underfunded by roughly $1 billion yearly.

According to USCIS, the following EB-5 related fees will be adjusted:

Immigration Benefit Request Current Fee Final Fee Change ($) Percentage Change I-526 Immigrant Petition by Alien Investor $3,675 $4,010 $335 9% I-485 Application to Register Permanent Residence $1,140 $1,130 ($10) -1% Biometrics Services $85 $30 ($55) -65% I-829 Petition by Investor To Remove Conditions $3,750 $3,900 $150 4% I-924 Application for Regional center Designation Under the Immigrant Investor Program $17,795 $17,795 $0 0% I-924A Annual Certification of Regional Center $3,035 $4,465 $1,430 47%

For prospective EB-5 investors, the I-526 Petition fees are set to increase by 9% and the I-829 fees by 4%. For regional centers, the I-924 application fee (the most expensive fee at USCIS) will remain the same, but the I-924A fee is set to increase by a significant 47%.
