Applications to be processed based on EB-5 visa availability Changes could ‘lengthen the timeline’, one attorney says

U.S. Citizenship and Immigration Services is changing how it processes applications for immigrant investor visas in an effort “to increase fairness in the administration of the program,” the agency said.

Starting March 31, applications for the EB-5 program will be processed according to existing visa availability instead of on the current “first in, first-out” basis, meaning USCIS will give priority to petitions where visas are immediately available, or soon will be available, the agency said Wednesday.

The EB-5 program creates a path to green cards for immigrants who invest at least $900,000 in U.S. commercial entities.
